To comply with the Immigration Reform and Control Act of 1986 (IRCA), all U.S. employers must verify the employment eligibility and identity of all employees hired to work in the United States after November 6, 1986 by completing Employment Eligibility Verification forms (Forms I-9) for all employees. Employers who hire or continue to employ individuals knowing that they are not authorized to be employed in the United States may face civil and criminal penalties.
In addition, as a recipient of federal contract funding, the University of Illinois System is subject to federal Executive Order 12989, which requires participation in E-Verify for employers with qualifying federal contracts containing the E-Verify clause. As a result, all new hires, all rehires (those who previously separated and are later hired back), and any existing employee who begins work on a qualifying federal contract, will be E-Verified. Information from the Form I-9 will be transmitted to the E-Verify system, and will be electronically checked against records contained in the Department of Homeland Security (DHS) and Social Security Administration (SSA) databases.
